By using Jobnow, you're agreeing to a few basic rules. Nothing scary.
Jobnow helps service businesses manage clients, send estimates, create invoices, accept payments, and communicate with customers via SMS. That's it. We're not your accountant, lawyer, or business partner.
Jobnow is operated by Jobnow Technologies Inc., a federally incorporated Canadian corporation headquartered in Quebec.
You agree to:
If someone uses Jobnow in a way that hurts others or the platform, we may pause or close the account. We'll be reasonable.
You own your data. We don't claim ownership over your customers, jobs, or messages. You can export your data or request a copy at any time.
We process your clients' data on your behalf to deliver estimates, invoices, and communications. See our Privacy Policy for details on how we handle data.
We do our best to keep Jobnow running smoothly, but:
To the maximum extent permitted by applicable law, we are not responsible for lost revenue, missed opportunities, or other damages resulting from outages or bugs. We do care and fix things fast.
We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to internet outages, carrier failures, third-party service disruptions (such as Stripe, Twilio, or Vercel), acts of government, natural disasters, or other force majeure events.
You can stop using Jobnow anytime. We can also end access if the platform is being misused.
When your account is closed, we will delete your data within 60 days, except where we are required by law to retain it (for example, financial records for accounting or tax purposes). You can request a copy of your data before closing your account.
Jobnow enables operators to send transactional and service-related SMS messages to their clients, including estimates, invoices, payment reminders, job updates, and other communications directly related to active services.
Jobnow acts solely as a communications facilitator and processor on behalf of the operator. Operators control message content and are solely responsible for ensuring they have obtained appropriate consent from their clients before sending SMS messages. Jobnow does not initiate or send SMS messages to clients independently of operator instructions.
Operators must not use Jobnow's messaging features to send unsolicited marketing, bulk promotional campaigns, spam, illegal content, or messages unrelated to active customer relationships or services.
Operators must:
Operators or clients may opt out of SMS communications at any time by replying STOP to any message sent from a Jobnow number. Standard message and data rates may apply.
Misuse of SMS features may result in suspension of messaging capabilities or termination of the account.
Jobnow's messaging infrastructure is designed to support compliance with CASL, TCPA, and applicable carrier standards; however, operators remain responsible for their communications.
Jobnow, its logo, and the platform's design and code are owned by Jobnow Technologies Inc. You may not copy, modify, or redistribute any part of the platform without our permission.
Your content (client data, estimates, invoices, messages) remains yours. We don't claim any ownership over it.
Warranty disclaimer. Jobnow is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the service will be uninterrupted, error-free, or secure.
Limitation of liability. To the maximum extent permitted by applicable law, Jobnow Technologies Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising out of or related to your use of the service. Our total liability for any claim arising under these terms will not exceed the amounts you have paid to Jobnow in the twelve (12) months preceding the claim, or one hundred Canadian dollars (CAD $100), whichever is greater.
Nothing in this section excludes or limits our liability for intentional or gross fault, fraud, or any liability that cannot be excluded or limited under the laws of the Province of Quebec or other applicable law.
Indemnification. To the extent permitted by applicable law, you agree to indemnify and hold harmless Jobnow Technologies Inc. and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your violation of these terms, or your violation of any applicable law or the rights of any third party. This does not require you to indemnify Jobnow for its own intentional or gross fault.
Dispute resolution. If there's a dispute, both parties agree to attempt to resolve it informally before commencing legal proceedings. You may contact us at eric@usejobnow.com to begin the process. If we cannot resolve a dispute informally within thirty (30) days, either party may pursue legal remedies as described below.
Governing law. These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts of the Province of Quebec.
No agency. Nothing in these terms creates a partnership, joint venture, employment, or agency relationship between you and Jobnow.
Severability. If any part of these terms is found to be unenforceable, the rest still apply.
We may update these terms from time to time. If we make material changes, we'll notify you by email or through the platform. Your continued use of Jobnow after changes take effect constitutes acceptance of the updated terms.
Language. These terms are drafted in English. A French version of these terms is available upon request. In the event of any discrepancy between the English and French versions, the English version shall prevail.
